In New York DWI-DUI offenses are governed by the Vehicle and Traffic Law, as opposed to the New York State Penal Code.  A conviction for DWI-DUI does, however, carry potentially major criminal liability.

Below is a chart of penalties that apply for a conviction related to a DWI-DUI related offense.  The chart outlines only court imposed criminal penalties, as separate DMV administrative penalties can be imposed.  Please note that this is only a summary and if arrested for a DWI-DUI related offense you should consult with a qualified attorney immediately.
