An E-2 Treaty Trader Visa is a non immigrant visa that enables applicants to enter the U.S. who are investing or have invested a substantial amount of capital in an enterprise in the U.S.  Like the E-1, the E-2 is not a dual intent visa and the applicant must show an intent to return to their home country.

 

In order to apply for an E-2 Visa,  the  applicant must meet the following eligibility requirements:

  • Applicant must be a national of a country that has a commercial trade treaty with the United States;

  • Applicant must direct or work on behalf of an enterprise that is at least 50% owned by nationals of the applicant's country;

  • Applicant must make an actual investment or is actively in the process of investing in the enterprise;

  • Applicant must show the funds used to invest come from legitimate sources of income;

  • The enterprise invested in is a "Commercial Enterprise";

  • The investment is substantial;

  • Applicant must show the enterprise being invested in is not a marginal business, meaning, among other factors, that it is one that will expand job opportunities;

  • The Applicant must show they are responsible for developing and directing the business
