The H-2B Visa program allows employers to hire foreign workers to perform temporary, nonagricultural work within the United States on a one-time, seasonal, peak-load, or intermittent basis. Under current immigration law, employers can petition for H-2B visas for particular workers.
The application process is complex and requires employers to prove the “temporary need” of workers. In addition, there are strict timelines for petitioning and a limited number of H-2B visas available. Because visas are limited, applications must be properly completed to avoid denials and potentially devastating loss of your workforce.
