A person is removable and deportable when they enter the country based on a marriage that took place less than two years prior to the date of admission and the marriage is terminated or annulled within two years of admission.
A person is also deportable for marriage fraud if it is determined by the Attorney General that the individual failed or refused to fulfill a marital agreement, which in the opinion of the Attorney General was made for the purpose of gaining admission as an immigrant.
The individual can, however, establish that the marriage was not entered into for the purpose of evading the immigration laws.
